The Captain of the Sunken Italian Yacht is Under Investigation. Is He Responsible for the Tragedy? (Exclusive)

James Cutfield is under investigation in connection with the yacht that sank off the coast of Sicily, claiming seven lives

The captain of a sunken Italian yacht is under investigation after the accident off the coast of Sicily last week that killed seven people and left 15 survivors . 

New Zealand-born James Cutfield, 50, was chief officer of the British-flagged yacht Bayesian , which sank during a storm in the Tyrrhenian Sea near the Sicilian port of Porticello on Monday, Aug. 19. 

He has been questioned several times by Italian authorities, a source close to the investigation previously told PEOPLE. Police have opened manslaughter and negligent shipwreck investigations in connection with the sinking, per Ambrogio Cartosio, the Chief Prosecutor of Termini Imerese.

Despite investigators’ focus on him, his actual culpability for the tragedy remains uncertain, as Italian attorney and legal expert Praxilla Trabattoni explains in this Q & A. (Trabattoni is also a contributing writer for PEOPLE). 

What does the interrogation of Cutfield mean?

Cutfield’s questioning does not immediately imply that he will be tried, Trabattoni says, given that this kind of investigation is commonplace for such incidents. 

This and similar cases require a preliminary investigation in which authorities notify parties involved so that they can appoint their own forensic experts and legal teams to participate in investigations, including, in this case, the autopsies of the victims. 

Is Cutfield under arrest?

While Cutfield is being investigated for negligent shipwreck and manslaughter , he is not under arrest. For a pre-trial arrest — as happened in the 2007 Amanda Knox case — there are certain criterion the prosecutors have to meet.

“First, the crime should foresee a sentencing of no less than five years,” Trabattoni says. “Secondly, there needs to be a serious indication of guilt.”

Third, she says, prosecutors would have to have concerns that the purported defendant is at risk of tampering with evidence or is a flight risk or could commit a similar crime.

Is there a precedent for a case like this?

This kind of investigation is not entirely unchartered territory.

Trabattoni notes similarities with the 2012 capsizing of Costa Concordia off the Tuscan island of Giglio, which killed 32 and left 4,200 survivors , as previously reported by the Associated Press and BBC.

Francesco Schettino, the captain of that ship, was later sentenced to 16 years in prison on charges similar to the ones Cutfield is possibly facing, per the outles. The search and rescue of the Bayesian is being conducted by the same crew that assisted with the Costa Concordia disaster, she says.

But there's a long way to go before Cutfield could meet a similar fate - including a bulletproof case from prosecutors.

How could authorities prove the captain's guilt?

Prosecutors have to prove beyond a reasonable doubt that the actions or omissions of the captain caused or contributed to the tragedy, Trabattoni says. They can do so by examining the boat and seeing if survivor and witness accounts are consistent with the physical evidence they find. 

For example, if the captain had heard that there was a weather alert and he failed to deploy the stabilizer, or if he decided not to go into a port that would have been provided a safe haven, or if he didn’t ensure that all the doors were shut during the night. These constitute behavior that would have contributed to the tragedy, Trabattoni says.

Prosecutors also have a legal obligation not only to look for evidence against the party, but also in favor of the defendant, requiring a diligent investigation of the case, she says.

What Could Cutfield Argue in His Defense?

The captain has to prove that he behaved and maintained his duties and obligations both during the tragedy and after, says Trabattoni. There's also the question, Was there anything he could've done to save lives?

He could also claim that it was an unforeseeable and unpredictable weather phenomenon and there was nothing he could've done to avoid a disaster, she says. He could also claim that there was design or manufacturer flaw in the vessel.

Are other surviving crew members culpable?

Several crew members are now expected to be placed under investigation, local news outlets  Rai ,  Adnkronos  and  Sky Italia  report. One of them is the  first mate of the yacht, Tijs Koopman , who has been asked to not leave the Sicilian city of Palermo so that he can be questioned, per  Corriere della Sera  and TV channel TG La7.

“What often happens, and what happened in the Costa Concordia case, is that those further down the pecking order will cut deals and explain everything that happened,” Trabattoni says. This usually implies the captain would get most of the blame and, in turn, a harsher sentencing, she adds. 

“Maritime law dictates that the captain is in charge and responsible for the boat, crew and all the people sailing with him so the ultimate responsibility and liability lies with him,” she says. 

The accident claimed the lives of several high-profile individuals. They have been identified by authorities as British tech entrepreneur Mike Lynch and his daughter, Hannah Lynch; the yacht's chef Recaldo Thomas; prominent New York attorney   Christopher Morvillo and his wife, Neda , and Morgan Stanley International chairman  Jonathan Bloomer and his wife, Judy .

Despite lower-than-average piracy incidents this year, the shipping and yachting industry continues to pressure all vessels to remain vigilant as violent attacks remain a concern. The International Chamber of Commerce International Maritime Bureau’s Piracy Reporting Center (IMB) detailed that sixty incidents of piracy and armed robbery against commercial ships were recorded in the first half of 2024, a decrease from 65 incidents for the same period in 2023.

ICC Secretary General John W.H. Denton AO says, “While we are reassured to see a fall in the number of overall reported acts of piracy, the concerning rise in incidents of a violent nature underscores the need for continued vigilance from the international community to ensure the safety of all seafarers — especially at this time of heightened uncertainty for maritime transport.”

Of the 60 incidents reported this year, 46 vessels were boarded, eight reported attempted attacks, four were hijacked, and two were fired upon. Perpetrators successfully boarded 85% of targeted vessels.

Violence towards crew continues, with 85 taken hostage compared to 36 in the same period last year, with 11 kidnapped and two threatened. Guns and knives were reported in 34 of the 59 incidents, a worrying increase from the same period the previous year. While most reported pirate attacks are on commercial vessels, Yacht owners are advised to maintain strict anti-piracy watch and measures, especially at anchor.

The Caribbean Safety and Security Net (CSSN), notes the top destinations in 2024 for theft aboard a private boat are Grenada, St Martin, St Lucia, St Vincent, British Virgin Islands, and Antigua. In February, the catamaran Simplicity was found abandoned off a beach on the island of St. Vincent. According to reports , the bodies of the owners were likely thrown overboard after their yacht was hijacked.

I spoke with yacht owners about how they are spending millions setting up their large yachts with military-style technology while training their crews to avoid conflicts, as well as MARSS , the leading company providing security solutions. They provide protection for the maritime and yachting industry against airborne, surface, and subsurface threats. This includes enhancing surveillance capabilities with AI detection and verification, as well as connecting to onboard countermeasures and remote support.

Systems like MARSS’ NiDAR have been using AI for years to learn, constantly improve, and help operators to work better, faster, safer.”

MARSS is already working on a system for yachts which would assist vessels experiencing rough waters and inclement weather.

Other protection additions for yacht owners include Long-Range Acoustic Devices (LRAD), which provide pain-inducing sound beams to invaders; Underwater Sonar Detection Systems, which detect movement below the surface; exterior lockdown systems, which provide total lockdown and are used on many yachts; and Safe Rooms, which act as fortified areas on a ship where the crew can take refuge in the event of a pirate attack.

Dutch superyacht builder Oceanco receives countless special security requests from clients as they fit their massive yachts. Among the requests are Citadel rooms, where owners can retreat to a hidden safe room to override access to the yacht's navigational and satellite communications systems. The rooms have ballistic-protected walls, an independent ventilation system, and water and food supplies.

Also requested are Emergency escape life pods that offer a rapid getaway, resist impact, and feature built-in GPS trackers, temperature and fire barrier controls, and air purification systems. Currently in development are Smart floors that track movement but can also be used to control lighting or heating.

There are certainly more lethal devices used aboard some superyachts. According to an eyewitness report in the Sunday Times, "The captain of a superyacht once deployed sonic weapons and 'pain rays' to fend off armed pirates in the Arabian Sea. The captain targeted ear-splitting, high-volume acoustics at the pirates using narrow beams of electromagnetic energy that trigger a burning sensation on the skin. The threat of pirate attacks is all too real. In some areas, such as along the coast of Africa in the Gulf of Aden, it's even expected. Any protective technology worth having will find its way aboard a yacht."

On Luxurious Ibiza, Essential Workers Are Forced to Live in Tent Cities

The Spanish island fills beachfront hotels and glittering dance clubs with wealthy tourists. But its teachers, firefighters and police officers can’t find a place to live.

At 1,900 euros a month, the rent was not cheap. But Alicia Bocuñano still felt fortunate to find an apartment on Ibiza at that price. As a taxi driver pulling 16-hour days, Ms. Bocuñano, a single mother who grew up on this Spanish island, figured that a surplus from the busy summer months might be enough to make the rent.

But her would-be landlord wanted six months of rent plus a security deposit up front — close to €14,000, or about $15,300, in one shot. Though not quite legal in Spain’s tightly regulated rental sector, such demands are common on Ibiza, where wealthy tourists fill beachfront hotels and glittering dance clubs while the people who work in those places — not to mention the island’s teachers, firefighters and other essential workers — can’t find a place to live.

In lieu of a new apartment, Ms. Bocuñano, 38, spent a frightening two weeks sleeping in her car, then three months in a tent with her 10-year-old son, Raúl, by her side, before buying a used caravan in June. For a couple of months, she stationed the Caravelair-brand trailer in Can Rova, an ad hoc village of tents, shacks and campers on the outskirts of Ibiza Town, the island’s capital, just behind a dealership selling expensive powerboats. “When we first came here it was cold,” she said. “Like, very cold.”

Tent cities began popping up here in 2023, but they have mushroomed in size and number this year. Can Rova, the largest of three major camps in and around the capital, was home to some 280 people this summer. On a recent July night, six people and a dog were bedding down on the floor in Ms. Bocuñano’s caravan.

Many Can Rova residents said that, with nowhere else to go, they hoped to stay indefinitely. But on July 31, the police made good on a court order to clear the camp, which had been erected on private land. (The owner is currently embroiled in an array of zoning and legal disputes.) Many said they planned to relocate to one of the other camps, even as those sites lacked the electricity, water and perimeter fence that made Can Rova accommodating.

Ms. Bocuñano was detained by the police during the mass eviction, and may face a fine.

In much of the world, homelessness correlates with a lack of work. But not on Ibiza, where the jobs are plentiful and the booming tourism sector depends on itinerant workers (with varying immigration status). Though seasonal labor has long strained the housing supply for a few months each year, the shortage now looks more structural.

“People who work every day to care for their children have no place to live,” Ms. Bocuñano said.

The rise of remote work and a surge in short-term rentals have erased many apartments from the market, compounding existing shortages caused by land-use restrictions on an island prized for its natural beauty, and by poor public policy that followed the burst of Spain’s housing bubble in 2008.

“It is fundamental,” said Carme Trilla, an economist and former director of housing policy for Catalonia, the Spanish region on “the peninsula,” as islanders are wont to say. “By definition they have to live there, and it’s not only price but also availability that is a problem.”

Ibiza’s deepening housing crisis came slowly at first, and then all at once. The island’s brand — “sun, beaches, nightlife,” as one broker put it — blossomed in the 1960s and ’70s as bohemians congregated on this Balearic Island. The flower children gave way to disco, and bell bottoms were pushed off the dance floor in the 1980s and 1990s by rave culture. By the 2000s, Ibiza had secured its reputation as a mecca for electronic music and luxury escapism.

“It is the only place in the world where you can see the top DJs in the world in top venues every night,” said Yann Pissenem, C.E.O. and owner of the Night League, parent company to Ushuaia and Hi, two of the island’s hottest clubs.

The island’s year-round population of 160,000 is double what it was 20 years ago and growing. During peak summer months, more than a million people make merry on the island at any given time, with upscale tourism putting still more pressure on housing.

Ibiza is an extreme example of a larger phenomenon in Spain, where about 12 percent of the gross domestic product comes from tourism. A recent report found that in 306 cities and towns considered tourism draws, rents are an average of 75 percent higher than the national average — the largest gap ever. Already this summer, thousands of protesters have turned up in other vacation spots including Malaga, Mallorca and the Canary Islands to demonstrate against the excesses of tourism.

Ms. Trilla, who now runs Habitat 3, a foundation that works to facilitate subsidized housing, said that on Ibiza, the crisis has been intensified by a new spate of discount airline connections to European capitals, and by more online platforms renting apartments to foreign visitors. The median price for a home on the island is now €558 a square foot — three times the national average and more than double the average in Madrid and Barcelona.

Three-quarters of prospective buyers on Ibiza are looking for a second home, while another 15 percent want an investment property, said Paloma Pérez Bravo, C.E.O. of Sotheby’s International Realty in Spain. So on an island with inadequate housing and limited buildable land, many homes sit vacant for much of the year. And since the pandemic, she added, there’s been more demand from buyers who want to live on the island year-round. “Ibiza is a good investment because the prices never stop rising,” Ms. Pérez said.

On a recent afternoon just before the demolition at Can Rova, residents related stories of crammed studio apartments where people would sleep in shifts on so-called “hot beds” for about €300 a month.

Maria Fernanda Chica, a 34-year-old Colombian who is awaiting working papers, lived in one such apartment while cleaning luxury homes for cash. “I couldn’t cook food when I needed to,” she said of the conditions. “At best I could use the kitchen once per day.”

This summer, she was living in a makeshift structure in Can Rova with her partner and teenage son. Most of the residents there rented plots for between €350 and €450 a month, plus €50 euros for water and another €50 for electricity. The residents were responsible for digging their own septic systems. A good number had built shanties from plywood, shipping pallets, AstroTurf, tarpaulins and other basic materials.

Jonathan Sanchez, 33, and his girlfriend Sandra Velasquez, 41, sleep in a tent among a few dozen others in another informal settlement. Mr. Sanchez, who was born on Ibiza, works construction by day. Ms. Velasquez, a Colombian émigré lacking work documents, works nights cleaning for €7 an hour.

“I don’t even remember the last time I went to the beach,” said Mr. Sanchez on a recent night. His T-shirt said “Ants” — the name of the party that Mr. Pissenem hosts on Saturdays.

The couple charge their mobile phones at bus stops and draw water from a tap in a nearby cemetery. Most of their neighbors are seasonal workers from Morocco who decamp after the summer season. Mr. Sanchez has been in his tent for 14 months. His co-workers have no idea where he lives. “It’s not that I am embarrassed,” he said. “I just don’t want people to feel sorry for me.”

Whenever campers like Mr. Sanchez are forced to move on, the Guardia Civil, one of Spain’s two national police forces, will likely play a role (as they did in the Can Rova eviction). But many of the officers are themselves caught in this housing crisis. At the height of tourist season, there were 17 vacant Guardia Civil positions on Ibiza. Many new recruits avoid work on the island and rotate out when they can find an opening elsewhere in Spain, said Tomas Quesada, a Guardia Civil officer and union representative. Starting salaries are just €1,800 a month, and the monthly €94.63 cost-of-living bonus makes little difference.

“It is leading to the desertification of public services,” Mr. Quesada said. “We have the right to be able to live.”

Nurses and doctors face a similar reality. So do teachers, some of whom commute daily by airplane from other islands to save money. “We don’t have the same level of public services here in Ibiza,” said Joana Tur Planells, a union representative for teachers.

Land will always be limited on a 220-square-mile island, but there is an emerging consensus that government intervention is needed. In the town of Santa Eulària des Riu, where Can Rova was located, City Hall plans to allocate 54,000 square feet of public land for housing construction over the next few years. Policy documents call for increased emphasis on the construction of multifamily dwellings and a crackdown on illegal short-term rentals.

Carmen Ferrer Torres, Santa Eulalia des Riu’s conservative mayor, points to plans to break ground on the construction of 60 smaller rental apartments — a fraction of the units needed to ease the strain.

“These are important, urgent problems with solutions that will take longer than we have,” the mayor said. In the meantime, her party also advocates further liberalizing rental markets, betting that streamlined evictions for scofflaws could free up stagnant housing stock. Ms. Ferrer was on site supporting the July 31 clearance of Can Rova.

But for Ms. Trilla, the housing economist, the big picture solution is clear. “It’s necessary to prioritize public housing for essential workers,” she said, adding that the problem is not just housing but the price of land. Basically, public money is needed to buy private property at market prices.

She pointed to a series of policies in Barcelona, the Catalonian capital, that might ease short-term housing supply, including one that would temporarily loosen zoning rules so officials could break up single-family homes into multiple apartments. Barcelona is also phasing out short-term rentals of the type offered by platforms like Airbnb. They will be virtually banned by 2028.

On the private side, successful business owners like Mr. Pissenem, the club impresario, are wrestling with the crisis. His company has begun helping its seasonal workers find accommodations. “We all need to figure out a way to help the people that hold the island in their hands,” he said.

For now, Ibizans like Ms. Bocuñano wonder where their next home may be. For the first couple of nights after the Can Rova raid, she stayed on a friend’s couch. Her son is staying with her mother on the other side of the island. She was briefly allowed back in to Can Rova to get her personal possessions, including her caravan, but needed to borrow a vehicle to tow it.

From there, she said, “I am going to recover and put the pieces back together.”

Burning Man not your style? Try this fiery Santa Fe festival instead

The Zozobra festival turns 100 this year, and it’s a family-friendly party that lets you put fears, anxieties, and even parking tickets to the torch.

The effigy figure, Zozobra is seen ablaze in flames. It is nighttime and there is an orange glow amongst the burning.

Each Labor Day weekend a communal event unfolds in the American West centered around the nighttime burning of a giant effigy. Amid chants and music, the towering figure is consumed by fire, toppling to the ground in a shower of flames and sparks.

Most people will think of Burning Man in the northern Nevada desert and its RV army filled with Silicon Valley executives in bodypaint and loincloths. With slow ticket sales this year, the gathering at Black Rock isn’t the only Western fire festival that weekend. Nor was it the first.

The history of Zozobra

Over the same end-of-summer, three-day holiday another, older conflagration unfolds in New Mexico. Marking a century this year,   Santa Fe ’s fiery   Zozobra festival   rivals the better-known technopalooza offering a similar vibrant atmosphere, communal spirit, and a familiar transformative finale of fire.

Like its Bay Area counterpart, the Zozobra festival was invented by bohemian visionaries.   In 1924, Pennsylvania painter   William Howard "Will" Shuster Jr.   created an effigy as the highlight for a party hosted by a collection of artists known as Los Cinco Pintores. It was part of a larger group of mostly Anglo painters (including Georgia O’Keefe) drawn to Santa Fe for its colorful landscapes and a culture   marked by Mexican and Native American influences.  

Shuster drew inspiration for his totem from Mexico’s Yaqui Indians and   their Easter Holy Week tradition , where an effigy of Judas is paraded and burned. The painter named his 6-foot-tall puppet Zozobra, a Spanish word meaning "anguish" or "gloom". Its burning symbolized the destruction of worrisome or negative feelings.   Now   50-feet six-inches tall , and constructed of wire, wood and cloth, Zozobra has become deeply intertwined with Santa Fe's identity. The effigy’s burning on the Friday night before Labor Day marks the start of the   Fiesta de Santa Fé –the city’s annual 311-year-old celebration of art, culture and heritage.

Celebrating a century-old tradition

“This community focus is what’s different between Zozobra and Burning Man. Zozobra is a tradition here,” says   New Mexico History Museum   Curator Hannah Abelbeck. “Zozobra wouldn’t exist unless Santa Fe cared about it and invested in it.”

To commemorate the festival’s 100th birthday, Abelbeck’s museum, located in downtown Santa Fe, has opened a new, two-year-long exhibition that explores Zozobra’s roots and cultural influences.   The New Mexico Museum of Art   on the city’s famed Plaza will also host a special exhibit about the tradition.

Santa Fe will hold other distinctive commemorations including   a Zozobra-inspired hot-air balloon debuting August 30   and public art devoted to the effigy.    

Casting fears into the fire

As always in the weeks prior to Zozobra’s burning, residents dutifully write down their fears and anxieties on slips of paper and drop them into boxes scattered across town. These are collected and their contents stuffed inside the puppet—adding additional fuel for the fire.     Sometimes citizens consign other totems of distress––mortgage papers, hospital gowns, speeding tickets and divorce––to the flames.

A crowd of 75,000 people is expected to converge on   Fort Marcy, a local park that’s a five-minute drive from Santa Fe’s Central Plaza, to watch the spectacle. People pass the time by consuming refreshments or tossing beach balls while Zozobra raises his arms and growls at the crowd as accompanying musical acts, dance performances, and storytelling underscore the city’s rich artistic traditions.  

As night falls, Zozobra’s nemesis, the dancing Fire Spirit appears. Armed with two torches she ignites the flammable giant. To chants of “Burn Him!” Old Man Gloom, as he is called, is consumed by fire and fireworks. With locals planning and running the festivities, everyone gets an opportunity to participate. In a world of extraordinary celebrations, Zozobra is a burning man for everyone.

Where to eat and stay in Santa Fe

While Zozobra will be the main event on Labor Day, other Santa Fe attractions worth exploring include   the Railyards , a former industrial neighborhood now revived and featuring all manner of restaurants, galleries, and on Saturdays, an outdoor artisan market. The   Georgia O’Keefe Museum   and the   Museum of Indian Art and Culture   are also worth a visit. The latter’s brand new   Joann and Bob Balzer Native Market and Contemporary Art Gallery   features non-traditional art like a British Triumph sports car decorated with Native American symbols.  

Visitors can try classic Santa Fe cuisine at   Cafe Pasqual’s , known for its breakfasts of corn meal pancakes or chorizo burritos.   Sazón   is a famed dinner spot with its signature soup made with poblano cream, crab meat, Mexican cheese, cinnamon and spices.  

Hotels in Santa Fe are as colorful and as varied as its cuisine. Many, like   the Inn and Spa at Loretto   and   La Fonda on the Plaza   are inspired by the city’s architectural traditions. Others by the city’s artistic ambitions such as the   Inn of the Five Graces,   a colorful mix of Hindu and Native American motifs.

Watch: 33m superyacht goes up in flames and sinks in Ibiza

The Bilgin motor yacht Good Vibes caught fire yesterday afternoon (August 2) in Ibiza. It is understood the yacht currently remains half-sunk in the port of Ibiza, after fire teams battled for five hours to extinguish the flames.

According to local media reports, the superyacht was “sailing” through the Es Freus marine reserve between Ibiza and Formentera at the time of the incident.

When the fire broke out, a commercial vessel stepped in to tow the boat to an empty dock in Ibiza port in order to help fire crews access the yacht.

It is understood that the blaze began in the engine room at around 2.30pm local time. After multiple fire teams battled the flames, the fire was put out around 8pm local time.

Footage on social media shows the yacht was experiencing a heavy stern list. She was towed across the marina, but was later seen capsized alongside a cargo vessel. 

No injuries have been reported.

A popular charter yacht , Good Vibes is a 2010 delivery from Turkish yard Bilgin. This model features accommodation for eight guests in five cabins and is crowned by a large sundeck with bar, jacuzzi and seating area.

Luxury yacht catches fire off Formentera

A 45-metre luxury yacht , the Aria SF , caught fire on Thursday afternoon and became totally engulfed by flames.

Around 5pm, the yacht was in the Cala Saona area of Formentera when the alarm was raised. The Maritime Safety Agency evacuated nine passengers, while the seven crew remained on board and attempted to contain the fire. But they soon had to be taken off as well, as the fire was totally out of control.

Luxury yacht engulfed in ball of flames off Spanish coast

This is the dramatic moment a luxury yacht caught fire off the Spanish island of Formentera.

Footage showed the 88-foot vessel engulfed in flames, with plumes of thick, black smoke billowing into the sky.

The Italian-designed cruiser was anchored off the beach of Es Cavall d’En Borràs in the Ses Salines Natural Park near where Hollywood A-lister Leonardo DiCaprio has been spotted partying in recent days.

Five crew members and 12 passengers scrambled to abandon the vessel in a race against the time.

Only one of the crew members, a 39-year-old Spaniard, suffered minor burns and needed hospital treatment, the regional emergency response coordinators said.

Onlookers gathered nearby in their own boats to watch the fire.

Flames could be seen spreading throughout the yacht in just a matter ofminutes, turning it into a fireball.

Local media reported that the vessel belonged to professional poker player Diego Gomez Gonzalez, aka ‘The Lion’, but this has not been confirmed by authorities.

It was not immediately clear this morning if the people on board were tourists who had chartered the yacht or guests of the owner.

Their nationalities have also not yet been made public either.

The alarm was sounded around 6pm on Saturday, with Spanish coastguards sent to the scene.

The yacht was towed further out to sea where the fire was put out.

Fire causes 33m superyacht to sink in Ibiza

It has been reported that the fire began in the engine room, fortunately, no injuries have been reported….

Yesterday afternoon (03/08), the 33m Bilgin superyacht ‘ Good Vibes’ went up in flames while cruising through the Es Freus marine reserve between Ibiza and Formentera. 

A commercial vessel was able to tow the yacht to an empty dock in Ibiza Port so that firefighters could put out the flames.

After fire teams spent five hours attempting to extinguish the flames, the superyacht eventually began sinking. It currently remains half sunk.

El Periódico de España have suggested that the crew were rescued before returning to the port, while the owner and the skipper decided to stay onboard. No injuries have been reported thus far.

Our rent charters fee typically includes the rental of the yacht or boat itself, the attendance of a professional staff, and all necessary safety equipment. Standard provisions may cover basic amenities, but additional costs such as fuel, marina fees, food and beverage expenses, and any special requests (e.g., water sports equipment, guided tours) are usually not included and can be arranged for an extra fee. It's important to discuss these details upfront to tailor the charter to your preferences while managing budget expectations.

More than 90 days before the charter start date: Clients may cancel their booking and receive a full refund of any amounts paid, less an administrative fee to cover processing costs.

60 to 89 days before the charter start date: Clients are eligible to receive a 50% refund of the total charter fee.

Less than 60 days before the charter start date: No refunds will be available, as we are unlikely to rebook the yacht for the specified period on short notice.

We strongly recommend clients consider travel insurance that covers charter cancellations due to unforeseen circumstances such as illness or travel disruptions. This ensures that your investment is protected, and you can look forward to your luxury yacht charter experience with peace of mind.

Immediate Concerns: If your complaint is related to the yacht or services provided during your charter, we kindly ask you to inform the captain or the head crew member as soon as possible. Many issues can be resolved quickly when addressed in real time, ensuring the rest of your charter experience remains enjoyable

Formal Complaint: If your concern cannot be resolved during the charter or if it pertains to issues before or after your yacht experience, please submit a formal complaint in writing within 14 days of the charter's conclusion. You can email us directly at [email protected] .

Investigation Process: Upon receiving your complaint, our customer service team dealing with Ibiza Yacht Charter will conduct a thorough investigation.

Resolution: We aim to resolve all complaints within 30 days of receipt. We will provide you with a written response detailing the outcome of our investigation.

  • If you are booking for a single day and your reservation is made 7 days or less in advance, the total price of your reservation is processed immediately.
  • If you are booking for a multi-day charter and your reservation is confirmed more than 30 days in advance, a deposit of 50% of the cost of the yacht is processed immediately in order to hold the yacht. Once your embarkation date is 30 days away, the other 50% is collected for the price of the yacht, plus the APA, plus the taxes due.

Terms of refunds are dictated by the Charter Agreement. Generally, once a payment is collected, it is non-refundable. In certain circumstances, as dictated by the Charter Agreement, credits can be provided so you will be able to enjoy your yacht charter at a future date that is convenient for you.

On the other hand, if you fancy a more relaxed day sailing and enjoying the wind, the most suitable option is a sailing boat, either a sailboat or a catamaran.

Another factor to take into account is whether you want to rent a boat in Ibiza just for the day or whether you want to spend several days or even weeks on board.

If you are clear about the boat you want, you can book directly through the boat's website, paying the 50% deposit required for confirmation.

Booking your boat with Be Charter Ibiza is very easy: we require a 50% deposit to confirm the booking to be paid by bank transfer, or by credit card through the online payment platform Stripe.

The remaining 50% of the charter, together with fuel and extras, is paid by credit card or cash on the day of the charter.
