  • Organize and attend your inspection.
  • Advise you on how to submit a bid in writing.
  • Await response patiently, indeed this sometimes takes a few days since it often involves a committee decision from the Seller(s).
  • If your bid is accepted, a contract is drawn up, including formalities, fiscal and legislative compliance requirements.
  • The boat will then be surveyed and sea-trialled by a qualified marine surveyor, as appointed and paid for by the buyer.
  • The surveyor(s) will then provide a written appraisal of the boat, engines, drives and other relevant components.
  • If the survey report is acceptable, the sale will be completed as per the agreed terms on the sales contract.

While we recommend the use of the Mediterranean Yacht Brokers Association Memorandum of Agreement (MYBA MoA), some institutions may ask their counsel to prepare and submit an alternative contract.

Safeguard of Funds in Escrow (Stakeholders)

Allied Yachting provides an escrow account for clients’ funds and ensures that at closing, as stakeholders, any existing loan or other encumbrances are paid off, as well as the fees of other parties involved in the transaction. This safeguard is of especially critical importance to the buyer and seller and can be a potentially serious hazard in a transaction like this.

Some financial institutions may prefer to use an independent Law Firm or Notary Public as an escrow agent.

Survey & Sea-Trial

The surveyor’s report will generally be determining whether the sale proceeds or not.

After a boat is repossessed, the lender will sell the boat by some means to recoup a part of its investment in the boat. These sales amount to liquidations, in which a lender is forced to take just a fraction of its investment in a boat in order to recover any amount. A buyer can buy a boat at this liquidation price, and likely save thousands. This takes place countless times per month all across the United States. Boat repossessions are on the rise nationwide, and more and more buyers are taking advantage of the opportunities created.

Repossessed boats range in size from tiny fishing boats all the way up to yachts. At the same time, the condition of these boats varies widely. In some cases, a repossessed boat will be recovered in excellent condition so that it is usable with no repairs or modifications. In other cases, boats are neglected before repossession, where owners stop maintaining and servicing boats after they stop paying for them. A buyer of a repossessed boat must exercise special caution in examining the boat before buying. A boat in non-working condition or in need of extensive repairs will probably not be worth investing in. Of course, boats repossessed from dealers generally do not present these problems. In many cases, these boats are new, even if sold at liquidation prices after repossession.

Repossessed boats are generally sold at auction. Auctions are operated by private auction dealers, who operate under contract with banks and lenders to conduct auctions of repossessed goods. An auction, of course, is a selling procedure under which goods are offered for sale by auction dealers in a competitive bidding procedure. Would-be buyers place bids or offers on goods, with multiple bidders participating, and the goods are sold to the highest bidder. Auctions for repossessed boats are now widespread.

The first hurdle to buying a boat at auction is to find an auction house to buy from. That is not quite as simple as it might seem. OFFER PROCEDURES

Offers are accumulated weekly through each Monday at 4:00 PM ET. In the event a particular Monday is a Federal Holiday, the deadline is extended an additional 24 hours. The high offer on a particular vessel is submitted to the Seller for consideration the following business day. The Seller, at its sole option, may accept or reject with or without a counter offer. Responses typically occur within 48 hours, no response constitutes a rejection of theoffer.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 1 business day to deposit into National Liquidators escrow account, the greater of 10% of Gross Offer or $1,000.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 5 business days to complete any and all conditions listed above in the “Conditions Of Offer”. In any case, any remaining amounts due must be deposited into National Liquidators escrow account, within 5 business days after notification of acceptance of an offer (either verbal or electronic). Successful Bidder’s failure to fund the total offer price within 5 business days after notice of acceptance will result in forfeiture of any deposits. In these instances, the vessel will be placed back into the auction cycle.

After funding the total offer price, Successful Bidder must remove the purchased vessel from National’s storage facility within two business days or make storage arrangements with National. Storage charges will accrue on ALL purchased vessels until each is removed from National’s storage facility. All vessels are sold AS IS, WHERE IS, with no warranties or representations, express or implied, as to condition or fitness for a particular purpose.

NOTICE REGARDING TITLING OR US COAST GUARD DOCUMENTATION

National Liquidators makes no guarantees, representations or warranties as to title or the ability to document or register the vessel. National Liquidators are acting as a broker only and issues as to title, documentation and registration are between the Buyer and the Seller, owner or lien holder. The required $399.00 administrative fee covers National’s efforts to obtain titling and documentation information from the Seller; it does not include transfer of title or documentation to Buyer. National Liquidators can process transfer of title or documentation to Buyer an additional fee. Buyers that are interested in this service can contact National’s title department for details, including charges. Ohio Law requires National to transfer title (not USCG documentation) directly to Ohio residents only, a $150 fee is charged for this service.

IMPORTANT INFORMATION REGARDING SALES TAX

Purchasers must pay sales tax at the applicable rate in their respective states. Dealers that wish to be treated as tax-exempt are required to provide a state sale tax number, valid marine dealer’s certificate, sign a Resale Certificate or Statement for Exemption of Purchase, and any other required documentation.

METHODS OF PAYMENT

All payments required herein must be in certified funds or bank check drawn on a US bank, wire transfer or cash. Personal checks or credit cards are not acceptable.

2. Be prepared to act fast – repo boats go quick.

Repossessed boats don’t stay on the market long. These watercraft are in high demand, especially at decreased prices. Don’t be surprised if a boat you’re interested in has multiple bids, which will drive the price up. 

Knowing how competitive repo boats are, it’s important to act fast when you’ve found a boat that you like. Waiting just a few days can cause you to lose the boat to another bidder. If you do miss out, don’t worry. There are plenty of other repo boats in the sea! 

3. Know what the boat is appraised at.

When a boat is listed as a repossession, it sometimes gets more attention because shoppers know it may be open to negotiation. However, it’s hard to know how low banks are willing to go. Before making a bid, know what the NADA Marine Appraisal  and  BUC boat appraisal guides say. Lenders usually use these guides as a benchmark when pricing boats. 

4. Be ready to clean and tidy up the boat.

Buying a repossession does not mean that you are compromising quality. A lot of repossessed boats are in decent condition – their owners just couldn’t afford them anymore. However, be prepared to give the boat a good cleaning and some basic maintenance. Most owners don’t tidy up their boats before a repossession. It’s also possible the boat hasn’t received maintenance in a while. 

5. Ask to do a survey and sea trial.

It’s strongly recommended to have the boat inspected before placing a bid. Ideally, you’ll want to do a thorough survey and make sure the boat is sea-worthy, though you’ll have to ask the bank. Also, if the boat has diesel engines, consider bringing along a diesel engine specialist who can take a look. You’re inheriting all of the boat’s problems when you purchase it, so you want to do your research.

When seeking a boat for sale, you may wish to consider a boat liquidation sale. Boat liquidation auctions are the result of boats which have been repossessed by the investor, usually the financial lender, and require immediate sales in order to offset the loss that the financers would obtain if the vessel was not sold. While this is unfortunate for the original purchaser of the boat, it does offer an ideal opportunity for qualified buyers to obtain the boat of his or her dreams for a fraction of the cost. However, before you attend a boat liquidation sale there are a few things that you should know.

Boat liquidators are in the business of obtaining capital quickly for the boat which was repossessed. In many instances, the bank or the lender will not take the time to have a full inspection of the vessel, but will just ensure that the boat can operate without sinking. As such, anyone who purchases a boat from a liquidation sale should be cautious of problems with the starter, the electrical system, outboard motors, and such.

Repo boats are sold as-is. This means that there are no warranty or guarantees to the boats. It is a coin toss that plays to the gambler nature and the deal seeker side of the business. This is not to state that liquidations are a bad thing, but rather that the purchaser should note that the reason that the boat is discounted is to avoid having to pay for inspections and (depending upon the repo company you choose) sea tests.

What is the history of the boat?

It is critical that when you go to a liquidation sale that you ask the seller about the history of the boat. Sometimes, not often, boats at repo sales will be police repossessions of stolen and stripped boats. While there may be an effort to spruce up the boat, there could be vital elements missing. Additionally, if a dealership is selling a boat as liquidation, the potential buyer should inquire as to the history of the boat. Has the boat been dry docked for a long time? Has the boat been wrecked? How many miles does the engine have upon it? All these questions should be asked prior to purchasing the vessel.

Just a little bit of work

Your inquiries into the boat’s history may yield the answer that the boat for sale needs minimal handyman work. Be cautious. While there could only be some minor cost involved in the “fix-up” process, the boat is being sold as-is and the repairs could become substantial. Think of it in terms of doing a rebuild on a house. There are always hidden costs, unforeseen problems, and fees that are not calculated in. Additionally, if you are purchasing an older model boat liquidation, parts may not be available or may be rather pricy, depending upon the model.
